I have been watching events in the Militia standoff in Oregon with some interest. That the Bundy bunch are not uneducated morons and parasites cannot be understated. But my concern is about the Hammonds. I do not care about their supposed crimes. I do care about the fact that they were sentenced to prison , served their terms and then arrested again by the order of a federal judge because they were not sentenced for a longer duration. To my mind the judge here is the criminal. The Hammonds were sentenced by Jury. In effect these people were tried twice for the same crime, and the second time no jury was involved. The jury decision shoud have priority over anything the judge may think. Samuel Chase 1776-signer of the declaration of independence-"The jury has the right to determine both the facts and the law". TO my mind the law in a case like this the law is not absolute. It takes a jury to determine just what the consequences should be and if the jury down graded the sentence then it is their right. If the judge can overrule the jury then why bother with a jury in the first place.
